Terms of Service

These Terms of Service ("Terms") govern your access to and use of Oscom ("we," "us," or "our"), including the website at oscom.ai, the application at app.oscom.ai, and all related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Description of Service

Oscom is an AI-powered go-to-market platform that provides tools for SEO analysis, content generation, advertising management, analytics dashboards, creative production, and outreach automation. The Service integrates with third-party platforms (including Google Search Console, Google Analytics, Gmail, and Google Calendar) to deliver unified marketing intelligence.

Features, integrations, and pricing are subject to change. We will provide reasonable notice of material changes to paid features.

2. Account Registration

To use the Service, you must create an account and provide accurate, complete information. You are responsible for:

  • Maintaining the confidentiality of your account credentials.
  • All activities that occur under your account.
  • Notifying us immediately at hello@oscom.ai if you suspect unauthorized access to your account.

You must be at least 18 years old to create an account and use the Service.

3. Payment and Billing

3.1 Pricing

The Service is offered at $49 per month for the base plan. Additional plans, features, or credits may be available at different price points as published on our pricing page.

3.2 Trial

We offer a $1 trial period to allow you to evaluate the Service. Trial terms, duration, and included features are specified at the time of sign-up.

3.3 Recurring Billing

Paid plans are billed on a recurring monthly basis. By subscribing, you authorize us to charge your payment method for the applicable fees through our payment processor, Stripe. All fees are quoted in US dollars and are non-refundable except as described below.

3.4 Cancellation

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period. You will retain access to paid features until that date. No partial refunds are provided for unused portions of a billing period.

3.5 Refunds

4. Acceptable Use

You agree not to:

  • Use the Service for any purpose that is unlawful or prohibited by these Terms.
  • Attempt to gain unauthorized access to our systems, other users' accounts, or any data not intended for you.
  • Transmit viruses, malware, or any other malicious code through the Service.
  • Reverse engineer, decompile, or disassemble any part of the Service.
  • Use the Service to infringe upon the intellectual property or privacy rights of any third party.
  • Resell, sublicense, or redistribute the Service without our written consent.
  • Use the Service to send unsolicited bulk communications (spam) in violation of applicable laws.

5. Data Usage and Third-Party Integrations

5.1 Your Data

You retain ownership of all content and data you provide to the Service. By using the Service, you grant us a limited license to process your data solely to operate and improve the Service.

5.2 Third-Party Integrations

The Service connects to third-party platforms (including Google Search Console, Google Analytics, Gmail, and Google Calendar) via OAuth 2.0 authorization. When you connect an integration:

  • We access only the data necessary to provide the features you have enabled.
  • Data from Google APIs is handled in accordance with the Google API Services User Data Policy, including the Limited Use requirements.
  • You may revoke any integration at any time from your account settings.

5.3 AI Processing

Certain features use artificial intelligence to generate content, insights, and recommendations. AI-generated outputs are provided as suggestions and should be reviewed before use. We do not guarantee the accuracy or completeness of AI-generated content.

6. Intellectual Property

The Service, including its design, features, software, documentation, and branding, is owned by Oscom and protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works of any part of the Service without our prior written consent.

You retain all rights to the content you create using the Service. We claim no ownership over your generated content, reports, or data.

7. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, store, and protect your information. Please review it carefully.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OSCOM AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

10. Indemnification

You agree to indemnify and hold harmless Oscom and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorney's fees) arising from your use of the Service, your violation of these Terms, or your infringement of any third-party rights.

11. Termination

We may suspend or terminate your access to the Service at our discretion, with or without notice, if you violate these Terms or engage in conduct that we determine to be harmful to the Service, other users, or third parties.

Upon termination:

  • Your right to use the Service ceases immediately.
  • You may request an export of your data within 30 days by contacting hello@oscom.ai.
  • After 30 days, your data will be deleted in accordance with our Privacy Policy.

You may terminate your account at any time by canceling your subscription and deleting your account from your account settings.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Any disputes arising under or in connection with these Terms shall be resolved through good-faith negotiation. If a dispute cannot be resolved through negotiation within 30 days, it shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Delaware, and the arbitrator's decision shall be final and binding.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Oscom regarding your use of the Service and supersede all prior agreements, understandings, and communications, whether written or oral.

15. Changes to These Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or through a prominent notice within the Service at least 14 days before they take effect. Your continued use of the Service after the effective date of any changes constitutes acceptance of the updated Terms.
